Course Objective & Scope
Generative AI and machine learning projects raise critical legal questions around personal data processing, cross-border cloud API transfers, trade secret protection and copyright. This course teaches legal, privacy and product teams how to mitigate KVKK, GDPR and intellectual property risks through technical safeguards and contractual clauses without stalling delivery.
Topics include lawful basis and purpose limitation, KVKK cross-border transfer mechanisms (Standard Contractual Clauses), PII redaction in prompts and RAG pipelines, data subject deletion requests, copyrightability of AI outputs and vendor IP indemnification. Participants complete a Privacy & IP Assessment Checklist on a real enterprise scenario.
Who Should Attend?
- In-house legal counsel, compliance specialists and KVKK / DPO teams
- Product managers and business owners building or deploying AI solutions
- Information security, data governance and IT procurement contract specialists
- Marketing, content creation, software engineering and R&D leaders
Key Takeaways
- Distinguish privacy obligations across model training, fine-tuning, RAG indexing and live inference
- Structure compliant cross-border LLM API usage with data minimisation and transfer safeguards
- Handle data subject access and erasure requests across vector databases and trained models
- Assess copyright ownership and third-party infringement risks in AI-generated code, text and images
- Negotiate no-training commitments, DPA terms and IP indemnity clauses in AI vendor contracts
Curriculum
Reading AI Architectures Through a Legal Lens: Training, RAG and Inference
- Where data persists: model weights, vector databases, caches and prompt logs
- Determining Data Controller and Data Processor roles under KVKK and GDPR
- Lawful basis, transparency notices and purpose limitation challenges
Cross-Border Data Transfers and Privacy-Enhancing Safeguards
- KVKK cross-border transfer rules when calling global LLM APIs or regional cloud endpoints
- Standard Contractual Clauses, zero-data-retention APIs and enterprise licensing
- Pre-prompt PII masking, pseudonymisation and synthetic data techniques
Data Subject Rights and Automated Decision-Making
- Handling erasure requests in RAG vector stores versus fine-tuned model weights
- Automated individual decision-making, profiling and the right to human intervention
- When to trigger a Data Protection Impact Assessment (DPIA)
Intellectual Property, Copyright and Trade Secrets
- Input risks: feeding copyrighted materials, client deliverables or proprietary code into AI
- Output ownership: can purely AI-generated text, visuals or code be copyrighted?
- Open-source licence contamination in AI-generated code and trademark infringement
Workshop: Drafting Protective Clauses for AI Contracts
- No-training warranties, sub-processor locks and audit rights in DPAs
- Evaluating vendor IP indemnification scope, caps and carve-outs
